Where applicable, the company&#8217;s website is accessible via the following link: <a href=\"https:\/\/milta.pro\/en\/\">https:\/\/milta.pro<\/a>.<\/p>\n<p>This privacy policy may be amended or supplemented at any time by the company, in particular with a view to complying with any legislative, regulatory, case-law or technological development. In such a case, the date of its update will be clearly identified at the top of this policy. These amendments are binding on the data subject as soon as they are published online. The data subject is therefore invited to regularly consult this privacy policy, as well as the rules governing the use of cookies, in order to be aware of any changes.<\/p>\n<h3>Personal Data<\/h3>\n<p>Generally speaking, access to certain information relating to the application may be possible without providing personal information. In any event, the data subject is only required to provide the information necessary for the use of the requested services or required by a legal or contractual obligation.<\/p>\n<p>However, in certain situations where the necessary information is not provided, the data subject may not be able to benefit from all or part of the requested services. In addition to the foregoing, it ensures that such data is processed in accordance with applicable regulations and this privacy policy. Where data relating to drivers, staff members or other individuals is entered into the application by a user company, whether Milta Solutions qualifies as controller or processor depends on the processing concerned and the instructions given by the user company.<\/p>\n<h4>Data Collected<\/h4>\n<p>Depending on the features used and the status of the data subject, the company may collect and process the following personal data:<\/p>\n<ul>\n<li>identification and contact data: surname, first name, phone number, e-mail address where provided, as well as profile information transmitted via a Google \/ Apple account where the data subject chooses this authentication method, within the limits of the permissions granted;<\/li>\n<li>account and device data: account identifiers, authentication information, device identifier and IP address used. No other connection log (date\/time, user-agent) is retained;<\/li>\n<li>professional and administrative data: VAT number, driving licence number, copy of or information appearing on the driving licence, identity card, residence permit, work permit, vehicle registration documents and other documents or supporting evidence provided in connection with the professional activity;<\/li>\n<li>vehicle and fleet data where these features are used, including vehicle registration documents and information necessary for fleet management;<\/li>\n<li>billing and financial data: billing details, subscription or transaction history, bank account number or IBAN where necessary for the service;<\/li>\n<li>delivery and route data: collection and delivery addresses, data relating to rounds, schedules, stops, distances, delivery events, proof of delivery and photographs entered into the application;<\/li>\n<li>device geolocation data (route recalculation only), where the relevant feature is enabled and used;<\/li>\n<li>evaluation and analysis data: indicators calculated from routes or services, results of analyses carried out using artificial intelligence systems, evaluations, scores, rankings and comparisons between drivers or routes;<\/li>\n<li>reviews, ratings or comments relating to drivers or services, if this feature is enabled.<\/li>\n<\/ul>\n<p>Data may be provided directly by the data subject, by the company to which they are attached or for which they act, by an authentication service such as Google \/ Apple, by the application&#8217;s distribution platforms, or generated during use of the application, in particular in the course of routes and deliveries.<\/p>\n<h4>Purposes of Processing<\/h4>\n<p>The company may process personal information provided or generated for the following purposes:<\/p>\n<ul>\n<li>creating, authenticating, securing and managing the data subject&#8217;s account;<\/li>\n<li>providing the information or services requested by the data subject and enabling the application to be used under the best possible conditions;<\/li>\n<li>organising, allocating and optimising rounds and deliveries, managing driver accounts, schedules and, where applicable, fleets;<\/li>\n<li>managing proof of delivery, documents, professional information and supporting evidence necessary for the use of the subscribed features;<\/li>\n<li>verifying, where necessary for the relevant feature, the identity, professional information and documents provided by independent drivers or companies;<\/li>\n<li>using device geolocation (route recalculation only);<\/li>\n<li>producing analyses, evaluations, scores or rankings and facilitating matching between companies and independent drivers;<\/li>\n<li>reusing certain route and usage data in order to improve the company&#8217;s features, calculation methods and artificial intelligence systems, within the limits permitted by applicable regulations and in accordance with the purposes disclosed to the data subject;<\/li>\n<li>managing subscriptions, billing, payments, premium products, options or bespoke services, and monitoring contracts entered into with the company;<\/li>\n<li>responding to requests for support, information or contact and ensuring the security, abuse prevention, maintenance and improvement of the application;<\/li>\n<li>compiling statistics relating to the use of the services and improving the company&#8217;s products and services;<\/li>\n<li>sending, where applicable and on an appropriate legal basis, marketing communications or a newsletter;<\/li>\n<li>complying with applicable legal and regulatory obligations and enabling the exercise or defence of the company&#8217;s rights in legal proceedings.<\/li>\n<\/ul>\n<h4>Legal Bases for Processing<\/h4>\n<p>Depending on the purpose concerned, processing is based on:<\/p>\n<ul>\n<li>the performance of a contract or of pre-contractual measures taken at the data subject&#8217;s request;<\/li>\n<li>compliance with a legal obligation to which the company is subject;<\/li>\n<li>the legitimate interest of the company or of a professional user in ensuring the security, management, improvement and proper performance of the service;<\/li>\n<li>the data subject&#8217;s consent, where required by applicable regulations.<\/li>\n<\/ul>\n<p>Where processing is based on consent, the data subject may withdraw it at any time, without this withdrawal affecting the lawfulness of processing carried out before such withdrawal. Where Milta Solutions acts as a processor on behalf of a user company, the purposes and legal bases of processing are determined by that company, subject to the processing that Milta Solutions carries out for its own purposes.<\/p>\n<h4>Route Tracking, Algorithm, Profiling, Evaluation, Scoring and Ranking<\/h4>\n<p>In connection with certain Milta features, the company may process data relating to routes and journeys. This data may be analysed or compared in order to optimise rounds, establish indicators, and evaluate certain elements relating to the performance of services.<\/p>\n<p>Artificial intelligence systems may be used to compare drivers or routes, analyse available data and generate recommendations and evaluations. Data from routes may also be reused in order to improve the company&#8217;s features, models and calculation methods, subject to compliance with compatible purposes, the applicable legal basis and the information provided to the data subject.<\/p>\n<h4>Recipients<\/h4>\n<p>The company is a recipient of personal information provided in connection with use of the application, to the extent necessary for the provision and management of its services.<\/p>\n<p>This information may also be accessible, depending on the features concerned, to user companies or individuals, account administrators, independent or employed drivers, as well as to processors, external service providers or partners that the company engages in connection with its legal or contractual obligations or in order to provide a complete and appropriate service to the data subject. Only the data necessary for the relevant purpose is disclosed.<\/p>\n<p>Neither the company nor any of its processors, external service providers or partners sells the data subject&#8217;s personal data, except with express notice and an appropriate legal basis, should a different model be implemented.<\/p>\n<h4>Retention Period<\/h4>\n<p>Personal information is retained by the company only for as long as corresponds to the purposes of collection set out above. In any event, unless a different retention period is required or justified by a legal or contractual obligation, data will not be retained for more than 10 years.<\/p>\n<p>Photographs constituting proof of delivery are retained for 8 days from the time they are recorded and then deleted, except where a legal obligation or a dispute requires different retention.<\/p>\n<h4>Data Storage Location<\/h4>\n<p>The company stores data on electronic media and, mainly, on a server whose privacy policies are available via the following links:<\/p>\n<ul>\n<li>[to be completed]<\/li>\n<li>Hosting provider Eonix (Belgium): <a href=\"https:\/\/www.eonix.be\/donnees-personnelles\/\" target=\"_blank\" rel=\"noopener\">https:\/\/www.eonix.be\/donnees-personnelles\/<\/a><\/li>\n<\/ul>\n<p>The database and photo storage are hosted on self-managed Docker infrastructure.<\/p>\n<p>The company does everything possible to guarantee data security through the implementation of technical and organisational measures in accordance with the standards applicable to this type of data and company.<\/p>\n<h4>Rights of the Data Subject<\/h4>\n<p>The data subject has the following rights, in accordance with the aforementioned European regulation:<\/p>\n<h5>Right of Access and Communication of Data<\/h5>\n<p>The data subject has the right to access and consult the personal data concerning them held by the company. The data subject may also find out how the company obtained such data and to whom it is disclosed. The data subject may also request a copy of the personal data being processed.<\/p>\n<p>Given the company&#8217;s obligation of security and confidentiality in the processing of personal data, a request for access to and consultation of data made by the data subject will be processed subject to proof of identity, in particular by providing an electronic or paper copy (accompanied by a signature) of their identity card during its period of validity. The request is, in all cases, free of charge for the data subject.<\/p>\n<p>The company may, however, object to requests that are manifestly excessive or unfounded (owing to their number or their repetitive or systematic nature, for example).<\/p>\n<h5>Right to Rectification of Data<\/h5>\n<p>The European regulation allows the data subject to request the rectification, updating or erasure of data concerning them that may be inaccurate, erroneous, incomplete or outdated.<\/p>\n<h5>Right to Object<\/h5>\n<p>The data subject has the right to object to the processing of data in the following two situations:<\/p>\n<ul>\n<li>where the exercise of this right is based on legitimate grounds; or<\/li>\n<li>where the exercise of this right is aimed at preventing the data collected from being used for direct marketing purposes.<\/li>\n<\/ul>\n<h5>Right to Erasure<\/h5>\n<p>The data subject has the right to request and obtain the erasure of data concerning them held by the company.<\/p>\n<p>The company will grant the visitor&#8217;s request if:<\/p>\n<ul>\n<li>the personal data is no longer necessary for the purposes for which it was collected;<\/li>\n<li>the processing of the data was based solely on the visitor&#8217;s consent and the visitor withdraws their consent;<\/li>\n<li>the data subject objects, on legitimate grounds, to the processing.<\/li>\n<\/ul>\n<p>In any event, the request for erasure may be refused by the company where it is necessary for the exercise or defence of rights in legal proceedings or for compliance with a legal or contractual obligation binding on the company.<\/p>\n<h5>Right to Data Portability<\/h5>\n<p>The data subject may request that their personal data be transmitted to a data controller identical to the company. The data subject may therefore ask the company to transmit the data to them in a structured, commonly used and machine-readable format.<\/p>\n<h5>Exercising These Rights<\/h5>\n<p>The aforementioned rights may be exercised by sending a letter to Milta Solutions SRL, Rue d&#8217;Angoussart 173, 1301 Wavre, Belgium, or by sending an e-mail to the following address: <a href=\"mailto:contact@milta.pro\">contact@milta.pro<\/a>.<\/p>\n<h4>Response Times<\/h4>\n<p>The company will respond to the data subject&#8217;s request, as far as possible, using the same means of communication as that used to exercise their right, unless requested otherwise or where this is not reasonably possible.<\/p>\n<p>The company undertakes to respond to any request for access, rectification, objection, erasure, restriction, portability or any other supplementary request for information within a reasonable period and, in any event, within one month of receipt of the request.<\/p>\n<p>Depending on the complexity and number of requests, this period may be extended by a further two months, i.e. a maximum of three months from the request, in accordance with the applicable European regulation. The data subject will be informed of this extension within the initial one-month period.<\/p>\n<h4>Persons Authorised to Access Personal Data<\/h4>\n<p>Only staff members, administrators, employees or service providers of the company who reasonably need the data because of the tasks and duties entrusted to them or the requirements linked to the company&#8217;s activity are authorised to access personal data, without prejudice to the recipients mentioned in this policy.<\/p>\n<h4>Authorised Providers and Transfer to a Country Outside the European Union<\/h4>\n<p>The company also informs the data subject that it uses authorised providers to facilitate the collection and processing of the data provided. In a mobile application, equivalent technologies may be used to ensure authentication, technical operation, security, audience measurement or certain features. Strictly necessary trackers may be used without consent where regulations so permit; other trackers are subject to the data subject&#8217;s prior consent where required.<\/p>\n<p>This use is carried out by the company in order to facilitate access to, navigation of and use of the application and, where applicable, the company&#8217;s website, to ensure their security and to improve the services offered.<\/p>\n<p>Certain trackers are strictly necessary for the operation of the website or application, or have the sole purpose of enabling or facilitating electronic communication. These may include, in particular, session identifiers, authentication mechanisms, preferences and elements necessary for account security.<\/p>\n<p>Other trackers or technologies may be provided by third parties and remain on the device or collect usage information in accordance with their own privacy policies.
